Photo Submission Contest - Legal Disclaimer and Ownership Acknowledgment
By submitting a photograph (the "Photo") to the Canyoufitmein contest (the "Contest"), you acknowledge and agree to the following terms and conditions:
Ownership and Rights:

You certify that you are the legal owner of the Photo and that you have all necessary rights, permissions, and consents to submit it to the Contest.
License Grant: 2. By submitting the Photo to the Contest, you grant Canyoufitmein (hereinafter referred to as "Fitmein") a non-exclusive, royalty-free, worldwide license to use, reproduce, distribute, and display the Photo for promotional and advertising purposes related to the Contest and Fitmein's services, including but not limited to social media, websites, print materials, and other marketing channels.
Release of Liability: 3. You release Fitmein, its officers, directors, employees, and agents from any claims, liabilities, losses, or damages arising out of or in connection with the use of the Photo as described in this disclaimer.
No Compensation: 4. You understand and agree that you will not receive any compensation, monetary or otherwise, for the use of the Photo as described herein.
Modification and Selection: 5. Fitmein reserves the right to modify, crop, edit, or otherwise alter the Photo as it deems necessary for use in promotional materials, without further consent from you.
Privacy: 6. Fitmein will handle the Photo in accordance with its privacy policy. However, you understand that once the Photo is submitted, it may be viewed and used by others, and Fitmein cannot control its distribution beyond its own platforms.
Compliance with Laws: 7. You agree that your submission of the Photo complies with all applicable laws and regulations, including but not limited to copyright, trademark, and privacy laws.
Dispute Resolution: 8. You agree that any dispute or claim related to your Photo submission must be brought within thirty (30) days from the date of submission, after which time all claims shall be considered waived. The exclusive jurisdiction and venue for any such dispute shall be the state and federal courts located in Atlanta, Georgia.
Indemnification Clause: 9. You agree to indemnify and hold Fitmein harmless from any claims, liabilities, losses, or damages arising out of the submission, including legal fees incurred in defending against such claims.
User Representations: 10. You represent that you are of legal age in your jurisdiction or have obtained parental/guardian consent if you are a minor and that you have obtained all necessary permissions for any identifiable individuals in the Photo.
By submitting your Photo to the Canyoufitmein Contest, you acknowledge that you have read, understood, and agreed to all the terms and conditions outlined in this legal disclaimer. Fitmein reserves the right to disqualify any Photo that does not comply with these terms.
